1. Acceptance of Terms
By downloading, accessing, or using the Tolloop mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
2. Description of Service
Tolloop is a peer-to-peer marketplace that connects providers of tools and services with buyers. Tolloop provides the technology platform only; we do not process, hold, or manage payments between users, and we are not a party to any transaction between a buyer and a provider.
3. Eligibility
- You must be at least 13 years old to use the Service
- If you are under 18, you must have the consent of a parent or legal guardian
- You must provide accurate, current, and complete registration information
- You must not have been previously banned or suspended from the Service
4. User Accounts & Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials
- You must not share your credentials with any other person
- You must promptly notify us of any unauthorized access to your account
- You must not use the Service for any illegal purpose
- You must not upload or transmit malware, viruses, or spam
- You are solely responsible for all content you submit through the Service
5. Buyer Terms
- Use subscribed tools and services responsibly
- Arrange and complete payment directly with the provider
- Communicate respectfully with providers at all times
- Report any issues through in-app reporting or to our support team
6. Provider Terms
- Provide accurate and truthful listings and descriptions
- Honor all contracts and agreements you enter into with buyers
- Respond to buyer inquiries in a timely manner
- Handle refund requests fairly and in good faith
- Comply with all applicable laws, including tax and consumer protection laws
7. Subscriptions, Contracts & Payments
Tolloop is not a party to any contract, subscription, or payment arrangement between buyers and providers. All pricing, payment methods, schedules, and refund terms are agreed upon and executed solely between the buyer and the provider. Refund requests must be directed to the provider.
8. User-Generated Content & Conduct Rules
Chat messages, profile information, and listing content are user-generated content. You may not post, transmit, or share content that includes:
- Harassment, bullying, or threats
- Hate speech or discrimination
- Sexual or sexually suggestive content
- Violence or incitement to violence
- Illegal content of any kind
- Spam or unsolicited promotional material
- Infringement of intellectual property rights
- False, misleading, or deceptive information
- Phishing attempts or fraudulent solicitations
- Malware, viruses, or malicious code
Users must use the in-app Report and Block features to flag abusive content. We reserve the right to remove content and suspend or terminate accounts that violate these rules.
9. Reporting & Blocking
- Every user profile and every chat message includes a Report button
- Every user can block any other user from within the app
- Reports are reviewed within 48 hours of submission
- Repeat offenders will be permanently banned from the platform
10. Intellectual Property
Tolloop and its licensors own all rights, title, and interest in the Service, including the app, website, branding, and underlying technology. You retain ownership of the content you submit, but by submitting content you grant Tolloop a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service.
11. Prohibited Activities
- Listing illegal items or services
- Misrepresenting tools, services, or your identity
- Harassing, threatening, or abusing other users
- Engaging in fraud or deceptive practices
- Using the Service for any unlawful purpose
12. Account Termination
We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time in-app (Settings → Delete Account) or by emailing [email protected].
13. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
14. Limitation of Liability
To the maximum extent permitted by law, Tolloop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including any disputes between buyers and providers.
15. Indemnification
You agree to indemnify, defend, and hold harmless Tolloop, its affiliates, and its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising out of or related to content you submit or your use of the Service.
16. Governing Law & Disputes
These Terms shall be governed by the laws of the applicable jurisdiction without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved through binding arbitration or, where not permitted by law, before the competent courts.
17. EULA Acceptance
By creating a Tolloop account, you accept these Terms of Service and our Privacy Policy as a binding End User License Agreement (EULA) between you and Tolloop.
18. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via in-app notice or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
